JSC Vows to Weed Out Corrupt Officials, Probe Magistrates Over Fake Warrant of Arrest

The Judicial Service Commission (JSC) has launched an investigation into some magistrates at the Harare Magistrates Court following a fraudulently issued warrant of arrest signed by an unknown magistrate. This warrant led to the incarceration of Marondera businessman Francesco Marconati for four days at Harare Remand Prison. JSC Secretary Walter Chikwanha confirmed that the commission is investigating the abuse of procedure regarding the alleged breach of a community service order by Marconati and his son Alessandro.

Information indicates that at the time of arrest, the police officers failed to produce a copy of the warrant of arrest but insisted that copies would be provided at the police station. Marconati, in the company of his lawyers, complied and followed the officers. At the police station, the officers produced a copy of an ordinary warrant of arrest issued on June 6, signed by one Magistrate Moyo.

The JSC has consistently called for integrity among its workforce to instill public confidence. As a sacrosanct institution, the JSC must not be compromised by undisciplined officers. The Second Republic maintains a zero-tolerance policy toward corruption.

In 2023, a similar case involved Public Prosecutor Henry Mugove Muringani, who received a punitive sentence for four counts of Criminal Abuse of Office. Muringani was found guilty of unlawfully preparing bail applications for suspects whose bail had been dismissed by the High Court due to the seriousness of the charges. He drafted false bail applications on behalf of the accused on less serious charges to make them eligible for bail.

In the same year, Harare High Court Judge Justice Webster Chinamora opted to resign rather than face a tribunal inquiry into his fitness to remain in office. The JSC had recommended the inquiry to President Emmerson Mnangagwa following corruption allegations against the judge. Realizing his untenable position, Justice Chinamora resigned. The JSC remains committed to weeding out corrupt officials to preserve its integrity.

The JSC should continue to impose punitive sentences on offenders to deter future corruption. Zimbabwe is on an economic recovery trajectory and cannot afford to be hindered by corrupt officials seeking personal enrichment.
